1. General Use

- You agree to provide accurate and up-to-date information when using our platform.

2. Services Offered
- Dinemetrics provides restaurant management solutions, including but not limited to order processing, reservation management, analytics, and POS software.
- We do not guarantee uninterrupted availability of our services and may perform maintenance or updates as needed.
3. Account Registration & Security
- You are responsible for maintaining the confidentiality of your account login details.
- Any activity conducted under your account is your responsibility.
- If you suspect unauthorized access, you must notify us immediately.
4. Payments, Refund & Cancellation Policy
- Certain features of our services may require payment. Pricing details are available on our website.
- Payments are non-refundable unless otherwise specified in our refund policy.
- Subscription renewals will be automatically processed unless canceled prior to the renewal date.
- Restaurants can cancel their subscription at any time, but refunds will not be issued for unused periods unless explicitly stated.
5. Data Processing & Ownership
- Restaurants retain ownership of all business data, including customer orders, transactions, and staff records.
- We store and process restaurant data only for operational purposes and do not share it with third parties unless required by law.
- Restaurants may request to export their data before canceling their subscription.
6. Compliance with Food Regulations & Taxes
- Restaurants are responsible for complying with local food safety laws, health regulations, and taxation policies.
- We provide tax calculation tools but do not file or remit taxes on behalf of restaurants.
7. Third-Party Integrations (Payment Gateways, Delivery Services, etc.)
- We integrate with third-party services, such as payment providers and delivery platforms, for enhanced functionality.
- We are not liable for any issues arising from third-party failures, including failed transactions, payment processing errors, or delayed deliveries.
- The availability of third-party integrations is subject to change without notice.
8. User & Staff Access Control
- Restaurant owners are responsible for managing staff accounts and access levels on the POS system.
- Different access levels may be assigned (Admin, Manager, Cashier, etc.), and owners assume responsibility for all actions taken under their staff accounts.
- Unauthorized access or misuse of the system may result in account suspension.
9. System Downtime & Service Interruptions
- While we strive to ensure 99.9% uptime, occasional service interruptions may occur due to maintenance, server failures, or third-party outages.
- We are not liable for any losses resulting from system downtime.
- Compensation for prolonged downtime is at our sole discretion.
10. Chargebacks & Fraud Prevention
- If a restaurant accepts online payments through our platform, chargebacks initiated by customers will be handled according to the respective payment provider’s policies.
- We reserve the right to suspend accounts that engage in fraudulent transactions.
11. POS Hardware & Software Liability
- If we provide POS hardware, it is covered under a limited warranty for a specified period.
- Warranty does not cover misuse, accidental damage, or unauthorized modifications.
- If only POS software is provided, restaurants must ensure their hardware meets compatibility requirements.
12. Intellectual Property
- All content, branding, and intellectual property related to Dinemetrics are owned by Athira Infotech LLP.
- You may not reproduce, distribute, or modify any part of our services without explicit permission.
13. Data Privacy & GDPR Compliance
- We collect and process personal data in compliance with applicable Indian and European data protection laws.
- Users accessing our services from the EU are protected under GDPR. Please refer to our Privacy Policy for more details.
14. Termination
- We reserve the right to terminate or suspend accounts that violate these Terms without notice.
- Users may terminate their accounts at any time by contacting support.
15. Governing Law & Dispute Resolution
- These Terms shall be governed by and construed in accordance with the laws of India.
- Any disputes shall first be attempted to be resolved amicably. If unresolved, disputes shall be subject to the jurisdiction of courts in Bangalore, India.
16. Changes to Terms & Conditions
- We may update these Terms from time to time. Any changes will be posted on our website, and your continued use of our services constitutes acceptance of the revised Terms.
